DISTANCE SELLING AGREEMENT

SUBJECT OF THE AGREEMENT

This agreement has been prepared by Handan Çalık via the internet under the conditions and terms specified below, for the sale of goods and services offered for sale in the virtual store serving on the www.atelier99.co website to the USER (BUYER OF GOODS AND SERVICES - MEMBER) and for the regulation of the rules and conditions regarding the use of this site.

In addition, Handan Çalık Virtual Store offers various communication services (voting, ordering gift packages, ordering custom-made products, requesting announcements, requesting promotional notifications, etc.) and the opportunity to shop electronically to its members, who are parties to this agreement, on the internet.

TERMS

A) Approval of the Agreement:

To shop from Handan Çalık Virtual Store, it is mandatory to become a member by filling out the registration form and obtaining the user password to be provided by the company. By filling out this membership form and obtaining the password, all the terms of the membership agreement are deemed accepted.

The e-mail address given during registration is unique to the member and can only create one membership with the same e-mail address. The "Password" is known only by the user. In addition, the password must be kept confidential by the member.

The member is responsible for the use of his/her password. The member has the right to change it at any time. However, the member is solely responsible for any liability arising from the use by third parties. Handan Çalık is not responsible for the use of this password.

B) Responsibilities of the Member:

1. The member acknowledges that all the information provided in the member registration form for benefiting from the virtual store services owned by Handan Çalık is correct and that he/she has made a correct statement. The member is personally responsible for any damages that may occur due to incorrect or false information provided.

2. If a mistake or misinformation is detected by Handan Çalık during the use of the virtual store application by the member, Handan Çalık may unilaterally terminate the membership.

3. The member acknowledges and undertakes that all services, software, and copyright related to this virtual store belong to Handan Çalık during the provision of all services during the virtual store application. In addition, the member accepts and undertakes that all services, software, sales, and copyrights belonging to this virtual store will not be reproduced, distributed in any way, and will not be used in other virtual environments or in real life in any way.

4. Furthermore, the Member agrees and undertakes that he/she will use the services provided by Handan Çalık in the virtual store in accordance with the terms of the membership agreement, and that he/she will not engage in any activities that would violate this agreement.

5. If the member does not comply with the responsibilities in the above articles, Handan Çalık cannot be held responsible for any damages that may occur. In addition, the member is responsible for any information, messages, and files that may be lost, incomplete, or incorrectly delivered during the use of the service. Handan Çalık is not responsible for this.

6. Handan Çalık accepts and undertakes that the member will not access unauthorized access to the services and product sales methods and prices applied in the virtual store, and that he/she will use this benefit in accordance with the membership agreement. In cases where the member does not comply with these articles, Handan Çalık cannot be held responsible for any financial and moral damages that Handan Çalık may incur. In these cases, Handan Çalık cannot be held responsible.

7. The member agrees and undertakes that Handan Çalık is not responsible for reading the member's data by unauthorized persons, cracking the password, or any damage that may occur due to spy programs on the internet.

8. In the virtual environment, the member agrees and undertakes not to send threatening, immoral, racist, messages contrary to international agreements, not to act in a way that affects the use of the service by other users, and to ensure that the correspondence, subject headings, and pseudonyms related to this environment comply with general morals, etiquette, and legal rules. In cases of such actions, the member is fully liable for any kind of damage that may occur to Handan Çalık.

9. The member agrees and undertakes not to sell any goods or services in Handan Çalık's virtual store, not to make offers for sale, not to engage in surveys, contests, or chain letter activities, not to send information or programs that would damage the information on other users' computers or software, not to print, distribute, or advertise any material or information that would stain the names of individuals or institutions or that is contrary to ethics, not to spread, not to accept, and not to share any material or information that is inappropriate or illegal in the law, morals, etiquette, and not to engage in any advertising activities. The member is fully responsible for any kind of damage that may be incurred against Handan Çalık as a result of such an action.

10. The member agrees and undertakes that Handan Çalık will not sell any goods or services through virtual means, will not make an offer for sale, will not engage in surveys, contests, or chain letter activities, will not send information or programs that would damage the information on other users' computers or software, and will not engage in any advertising activities, without permission, in connection with all services and campaigns provided by Handan Çalık in the virtual store. The member has accepted this.

11. Handan Çalık may change its information, sales prices, and conditions as it wishes at any time. The member accepts this.

12. Handan Çalık may monitor and control the entire system continuously or partially. Handan Çalık may intervene in or terminate memberships unilaterally if they violate the rules of membership or if deemed necessary.

13. All goods and services purchased by the member will be made with a valid credit card, and the member will benefit from all shopping services only with a credit card.

14. The member acknowledges that he/she must make a purchase transaction in the virtual store by means of a valid credit card, that he/she cannot shop from the system when the validity of the credit card is not confirmed, and that this product and service will not be provided by Handan Çalık.

15. At the time of delivery of the product and service purchased by the member from the virtual store, the member must show a valid identity card, allow the recording of the relevant identity information, and sign in the relevant places. Otherwise, and if no signature is made, the product may not be delivered to them. The member accepts this.

16. If the product purchased from the virtual store is received by another person, the person receiving the product must sign a document stating that they "know the person who sent the product," and if the document is not signed, the product may not be delivered, and therefore, the order will be considered unfulfilled. The member accepts this.

17. The member accepts that the address in the membership form is considered as the official notification address. In case a different address is reported, the responsibility belongs to the member.

C) Responsibilities of Handan Çalık:

1. Handan Çalık is responsible for ensuring the protection of the information of the persons who become members of the virtual store.

2. This information will not be used without the consent and approval of the member.

3. Virtual store services will be used for commercial purposes.

4. During this use, it will act in accordance with the laws and regulations of the Republic of Turkey.

5. It will not send information prohibited by law and postal regulations and will not distribute chain mail (chain mail), software viruses, etc.

6. Handan Çalık undertakes to provide the unsubscribe link that will allow the member to leave the daily mailing list at the bottom of the sent emails.

RESULT:

The address in the membership form is considered the official notification address. In case of a dispute, Istanbul Courts are authorized. In case of a dispute, the records in the computer main memory of Handan Çalık regarding the membership form and services are essential.

The member accepts that these records are valid and are definitive evidence within the scope of Article 287 of the HUMK (Turkish Code of Civil Procedure).
